2. Online Reservation & Inventory Management
Dynamic Inventory Changes: The online reservation system on this Website endeavors to maintain real-time inventory data. However, due to multi-channel rentals (e.g., simultaneous walk-in rentals, phone bookings, and online reservations), system delays leading to stock shortages may still occur.
Unfulfilled Reservation Handling: If a reserved wheelchair cannot be delivered as scheduled due to unexpected equipment damage, late return by a previous renter, or website system malfunction, the Company will notify you at the earliest opportunity and assist with either exchanging for an equivalent model or processing a full refund. The Company shall not be liable for any indirect losses arising from reservation cancellations or changes (such as travel delays, transportation costs, or losses related to flight/attraction tickets).
3. Physical Equipment Delivery & Condition Verification
Physical Agreement Execution: Completing an online reservation and payment via this Website only reserves the rental slot for the equipment. The hirer is still required to sign a physical "Wheelchair Rental Agreement" and cooperate with equipment inspection upon pick-up or delivery.
Verification of Equipment Condition: All wheelchairs (including all accessories) provided by the Company undergo basic cleaning and functional inspection prior to delivery. The hirer is responsible for inspecting and confirming on the spot that the wheelchair's brakes, tires, structure, and relevant accessories are functioning normally upon pick-up. Once the wheelchair leaves the rental location or completes delivery hand-over, the hirer is deemed to have confirmed that the equipment is in a safe and workable condition.
4. Safety Instructions & Limitation of Liability
Safe Operation Guidelines: The hirer and actual user must strictly comply with operating instructions and safety regulations during the rental period. The hirer must ensure that the actual user's physical condition is suitable for operating the wheelchair, and where applicable, that the wheelchair is operated with the assistance of an accompanying caregiver possessing appropriate capacity.
Exclusion of Liability: The Company accepts no legal liability or obligation to indemnify any personal injury, property damage, or accidental mishaps caused by any of the following circumstances:
Negligence, improper operation, overloading, or failure to use the wheelchair correctly.
Forcing passage through unsuitable terrain (e.g., steep slopes, stairs, uneven surfaces).
Failure to properly engage brakes, safety belts, or anti-tippers.
Unauthorized dismantling, modification, or self-repair of the wheelchair.
Third-Party Liability: During the rental period, if the use of the wheelchair results in any third-party personal injury, death, or property damage, the hirer shall bear all legal and compensatory responsibilities independently, without any involvement of the Company.
Statutory Exception: Pursuant to the Control of Exemption Clauses Ordinance (Cap. 71 of the Laws of Hong Kong), nothing in this Disclaimer intends to, nor shall it operate to, limit or exclude liability for death or personal injury resulting from the Company's negligence.
5. Equipment Damage & Custody Obligations
Custody Duty: During the rental period, the hirer has a duty of care to properly store and maintain the wheelchair.
Compensation for Loss or Damage: If the wheelchair is damaged (beyond normal wear and tear), lost, or stolen during the rental period, the hirer shall pay the full cost of repairs to the Company or compensate for a new replacement unit of the same model based on market price.
6. Network Security & Third-Party Links
System Maintenance & Disruptions: The Company strives to maintain stable operations of the Website. However, the Company makes no express or implied warranties and accepts no liability for website service interruptions, data loss, transmission delays, or errors caused by telecommunications supplier line faults, acts of God, cyberattacks, server maintenance, or any force majeure events.
